Use caution with patent placements; best way to purchase a personal use airplane and protect personal assets

DEAR A.N.: There is no way one can protect their assets completely other than with a heck of a lot of insurance. My airplane is a separate corporation, and I suggest that you do the same. The problem with that is that the likelihood is that you will be the pilot and if there were an accident, they would go after the owner of the airplane, the corporation that you are going to open and you, the pilot. You will likely have to find a carrier that will give you $1 million underlying insurance and then an umbrella on top of that for an additional four, five or more million. It sounds like a lot of money, but from personal experience, I can tell you that the numbers can add up quickly in the event of an incident. Keep your wheels up.

DEAR BRUCE: I'm 20 years old, and I have been listening to you since I was age 9. I have taken a path that seems less traveled, being 20 and not in college. I am the general manager of a local restaurant and will most likely be in business with my Dad within the next seven or eight years. I hope to be married in the summer of 2003. I rent with a friend and only pay $200 a month. It's a great arrangement, but I can't continue to do that when I get married. Is the summer of 2003 a good time to buy a house with my bride, or should we wait until we make more money? The more the store makes, the more I make, which currently is somewhere in the area of $45,000 a year. -- M.C., via e-mail

DEAR M.C.: Thanks very much for writing. Guys like you make this whole thing worthwhile. I'm delighted that I have had some influence on your life. Unhappily, there is no pat answer to your question. First of all, I have no notion as to what 2003 will bring -- I have a tough time looking ahead more than two or three weeks. Whether or not the market will be soft, whether you will be earning more money, whether you intend to stay in one place, all of these variables and more must be considered. Perhaps the most important thing is to realize is that when you purchase a home, it is not an investment on which you should expect a return.

That is not to say that you won't have a return, however the investment is in lifestyle. I suggest that for a person as young as you and your intended, the best way to go would be to rent for a time until you get your life together. That certainly is not written in stone. As to the different path that you are taking, college is not necessarily the key to success. However, it has the ability to your horizons. You consider going to school on a part time basis, not for vocational reasons, but for personal expansion.

DEAR BRUCE: I sent money to two different patent placement companies and have had no results. In fact, they won't even return my calls. I know I should have learned after the first one, but when you believe in your invention and want to profit from it, you can make bad decisions. I have been told that you have mentioned many of these companies have bad reputations. I wish I had listened to you before I spent my money. Are there reputable patent assistance companies? Is that the best way to sell an invention to a manufacturer? -- M.S., via e-mail

DEAR M.S.: You are correct in your observation that I have mentioned many times why it is wise to avoid these companies, and I would repeat that admonition. I would not recommend any company that advertises extensively concerning patent help. Without knowing what you have in mind, it's difficult for me to make specific recommendations.

In general, if your ideas are solid and you are prepared to invest money, the first thing to do is to find out if it can be protected by a patent, copyright or some other process. In that same investigation, you need to find out whether someone else has already done that, which is often the case. In the event that it can be protected, you should take the steps to institute that protection. That is probably the least expensive and easiest part of this path. The next is to consider whether or not you will be able to pay for the initial manufacturing or if the only feasible way is with a larger firm; and that road has many twists and bends. If you could get back to me with specifics, I would be very happy to comment again.
