Even death brings no relief


http://www.jewishworldreview.com -- DEAR BRUCE: My father-in-law has terminal cancer. He has leased an expensive automobile for two years. He put a sizable amount down on the vehicle to lower his monthly payments. He has another month to live. How can his executor trade the vehicle in and not lose the equity? -- M.S., via e-mail

DEAR M.S.: The likelihood is that there will be some loss, but it probably would be to your advantage to pay off the vehicle and then sell it.

Your father-in-law's estate can be held responsible for the completion of the lease without regard to his ability to use it. Given the fact that you have a fair amount of equity in the automobile, I believe that you will be able to purchase it -- thereby closing out the lease -- and then sell it and recapture most, but very likely not all, of his investment.

DEAR BRUCE: We are retiring and will have a decent retirement income. What we would like to do is continue to fund our IRAs. Are we able to do that? -- A.H., Belleview, Kentucky

DEAR A.H.: Money that is used to fund the IRAs must be earned. For traditional IRAs, it can be earned income without taxes taken out. Roth IRA funds must come from after-tax earned income. In both cases they must be earned by the sweat of your brow, not by dividends.

DEAR BRUCE: I just purchased a brand-new automobile in February of this year. Recently it was damaged in a severe hailstorm. When I picked it up from the body shop, the owner asked me who had done the previous hail damage repair work.

When I asked him what he meant, he said that there was previous damage that had been repaired very well. The dealer never told me this, and I am a bit upset. -- S.M. Tulsa, Oklahoma

DEAR S.M.: Like you, I would be upset. However, you should understand that many times vehicles are damaged prior to their reaching a dealer or on the dealer's lot. The question, which I don't have an answer for, is how much damage can occur before the dealer is required to mention it to a buyer?

Perhaps some of my readers could inform me of specific laws in their states. Is there legislation requiring the dealer to notify the buyer about damage that has been repaired? My spies have not been able to turn anything up. Perhaps you all can help.
