Construction and cash; qualifications for rates for first-time home buyers


http://www.jewishworldreview.com -- DEAR BRUCE: I have never been a home buyer, but with the current low interest rates, I have been considering buying a home. What are the qualifications for rates for first-time home buyers? -- R.C., via e-mail

DEAR R.C.: Interest rates are not a reason to buy a house. Purchasing a house is purchasing a lifestyle, one that may or may not make you comfortable. You failed to mention whether you were married and have children. These are variables to consider. There was a time when you could be almost guaranteed that your home would go up in value. That time has passed. Not only have many homes not appreciated, but some have depreciated significantly. If you want a home because this is the way that you choose to live, that's one thing. To purchase a home because it is possible to do so because of lower interest rates is foolish. As to first-time buyer help, this is generally a state or even a county proposition and must be researched locally.

DEAR BRUCE: You have mentioned that when building and paying cash, one should take precautions. Can you tell me what some of these may be? -- F.W., via e-mail

DEAR F.W.: They are legion. When you contract to have a builder build your home, oftentimes it is set up so that he can make draws against either cash or money advanced by the bank. Whether it is borrowed or your own money is immaterial. The fact is that many times this leads to builder fraud, which is the homeowner's responsibility to cover.

For example, suppose that the company who constructs the foundation bills the contractor. The contractor, in turn, shows you a bill, which you then pay. He then pockets the money and doesn't pay the contractor. Sometime down road, the foundation contractor files a lien against the house for the work performed. In the meantime, the builder goes bankrupt. Even though you have specifically paid the builder for that service, you are now responsible for the payment to the concrete man.

Building a home is full of traps of this kind. You would be well advised to have a sharp real estate attorney and, unless you have a great deal of time of your own, an architect or someone similar overseeing the job to check for overcharges or worse yet, cheating by a dishonest builder.

DEAR BRUCE: I may have the opportunity to purchase an 18-year-old established preschool. Here are the stats: 92 students, four teachers, average tuition $62.50 per month, annual gross income $51,750, yearly expenses $24,750. Enrollment for next year is currently at 68. The owner does not want to sell the name of the business, but he will sell the entire inventory, including chairs, tables and books. What would be the fair market value of this operation? -- K.M., via e-mail

DEAR K.M.: It would seem to me that this business has little or no value, when you consider that the owner is working there on a full-time basis. I have to conclude that most, if not all, of the students are part time a day or two a week. With the small gross income, it looks to me that the new owner would have done nothing more than bought himself a job. I can see only a tiny value in the business, and that is whatever the inventory is -- tables, books, chairs, etc. The business just isn't there.

You mentioned that the current owner has four teachers. The teachers have to be only part time, given the fact that if they were paid even a modest salary on a full-time basis, it would have exceeded his entire annual expense. If he wants to get out of this for a few pennies for his inventory, that's fine. Otherwise I would look elsewhere.
